Scientists and biologists are challenging themselves to explain the mental and behavioral processes of genders. She focuses on five topics that the theory argues proving them wrong, and using them for support. The first area the theory introduces â€Å"men are more promiscuous and less sexually reserved than women are† (30). Evolutionary psychology proposes that men are always after sex. They explicitly say men hold a special force attracting them to sex which women cannot fully comprehend. Angier explains that men can be open about their sexual life, unlike women who are impacted by culture and society. Women are judged as â€Å"either chaste or trampy† (35) a woman is seen as pure or a slut. Since the beginning of time women are looked down upon when regarding their sex life. Harassment of women based on their sex life is due to religious and/or cultural influence, which has a stronghold over American society. It also says that a healthier younger woman will be able to carry his children. I disagree with this reason, I think that media influences what we expect from people. Unconsciously in our society we are brainwashed by magazines, TV and advertisements, to tells us how we should be and who we are attracted to. If a young child plays with Barbie’s, it automatically gives her the stereotype of how she is theoretical to look like when she is older. Women constantly have an urge in our society to be thin, models and actors tell us how we are supposed to be. If we look at another society for example Africa, I found this article on the web about men attracted to fat women being another type of society. â€Å"They conducted a study in South Africa where fat women are preferred (like many other places) and theyve found correlation that relate to fertility, health, and even how hungry a guy is, due to evolutionary instincts. Important School Tips for Parents From a Principal For teachers, parents can be your worst enemy or your best friend.  Over the course of the last decade, I have worked with a handful of the most difficult parents, as well as many of the best parents. I believe that the majority of parents do a terrific job and genuinely try their best. The truth is that being a parent is not easy. We make mistakes, and there is no way we can be good at everything. Sometimes as a parent it is critical to rely on and seek advice from experts in certain areas. As a principal, I would like to offer a few school tips for parents that I believe every educator would want them to know, and that will also benefit their children. 1. Be Supportive Any teacher will tell you that if a child’s parent is supportive that they will gladly work through any issues that might arise over the course of the school year. Teachers are human, and there is a chance they will make a mistake. However, despite perception, most teachers are dedicated professionals who do a terrific job day in and day out. It is unrealistic to think that there are not bad teachers out there, but most are exceptionally skilled at what they do. If your child does have a lousy teacher, please don’t judge the next teacher based on the previous, and voice your concerns about that teacher to the principal. If your child has an excellent teacher, then make sure that the teacher knows how you feel about them and also let the principal know. Voice your support not only of the teacher but of the school as a whole. 2. Be Involved and Stay Involved One of the most frustrating trends in schools is how the level of parental involvement decreases as a child’s age increases. It is an extremely discouraging fact because children of all ages would benefit if their parents would stay involved. While it is certain that the first few years of school are arguably the most important, the other years are important as well. Children are smart and intuitive. When they see their parents taking a step back in their involvement, it sends the wrong message. Most children will start to slack off too. It is a sad reality that many middle school and high school parent/teacher conferences have an exceedingly small turnout. The ones who do show up are the ones that teachers often say don’t need to, but the correlation to their child’s success and their continued involvement in their child’s education is no mistake. Every parent should know what is going on in their child’s daily school life. A parent should do the following things every day: Ask your child how their school day went. Engage in conversation about what they learned, whom their friends are, what they had for lunch, etc.Make sure your child has time set aside to complete homework. Be there to answer any questions or assist when needed.Read all notes/memos sent home from the school and/or teacher. Notes are the primary form of communications between a teacher and parents. Look for them and read them to stay up-to-date on events.Contact your child’s teacher immediately if you have any concerns.Value your child’s education and express the importance of it every single day. This is arguably the single most valuable thing a parent can do when it comes to their child’s education. Those that value education often thrives and those that don’t often fail. 3. Do Not Bad-Mouth the Teacher in Front of Your Child Nothing undermines the authority of a teacher any faster than when a parent continuously bashes them or talks bad about them in front of their child. There are times when you are going to be upset with a teacher, but your child should never know exactly how you feel. It will interfere with their education. If you vocally and adamantly disrespect the teacher, then your child will likely mirror you. Keep your personal feelings about the teacher between yourself, the school administration, and the teacher. 4. Follow Through As an administrator, I cannot tell you how many times I have dealt with a student discipline issue where the parent will come in tremendously supportive and apologetic about their child’s behavior. They often tell you that they are going to ground their child and discipline them at home on top of the school’s punishment. However, when you inquire with the student the next day, they tell you that nothing was done. Children need structure and discipline and most crave it on some level. If your child makes a mistake, then there should be consequences at school and at home. This will show the child that both the parent and school are on the same page and that they are not going to be allowed to get away with that behavior. However, if you do not have any intent on following through on your end, then do not promise to take care of it at home. When you practice this behavior, it sends an underlying message that the child can make a mistake, but in the end, there is not going to be a punishment. Follow through with your threats. 5. Do Not Take Your Child’s Word for the Truth If your child came home from school and told you that their teacher threw a box of Kleenexes at them, how would you handle it? Would you instantly assume that they are telling the truth?Would you call or meet the principal and demand that the teacher be removed?Would you aggressively approach the teacher and make accusations?Would you call and request a meeting with the teacher to ask them calmly if they could explain what happened? If you are a parent who chooses anything other than 4, then your choice is the worst kind of a slap in the face to an educator. Parents who take their child’s word over an adult before consulting with the adult challenge their authority. While it is entirely possible that the child is telling the truth, the teacher should be given the right to explain their side without being viciously attacked first. Too many times, children leave out crucial facts, when explaining situations like this to their parent. Children are often devious by nature, and if there is a chance they can get their teacher in trouble, then they will go for it. Parents and teachers who stay on the same page and work together alleviate this opportunity for assumptions and misconceptions because the child knows they won’t get away with it. 6. Do Not Make Excuses for Your Child Help us hold your child accountable. If your child makes a mistake, don’t bail them out by constantly making excuses for them. From time to time, there are legitimate excuses, but if you are constantly making excuses for your child, then you are not doing them any favors. You won’t be able to make excuses for them their whole life, so don’t let them get into that habit. If they didn’t do their homework, don’t call the teacher and say it was your fault because you took them to a ball game. If they get in trouble for hitting another student, don’t make the excuse that they learned that behavior from an older sibling. Stand firm with the school and teach them a life lesson that could prevent them from making bigger mistakes later on.

2. If we assume Simone is an employee, is PR PRO in breach of a common law duty in relation to not giving Simone any days off work or holidays? 3. If we assume Simone is an employee, does she have an entitlement to notice, at common law or pursuant to legislation, if PR PRO decides to replace her? Common law introduced number of tests to identify the status of individual in organization: First test applicable by the Court’s are â€Å"Control Test†. This test is determined by Court in case law Zuljs v Wirth Bros Pty Ltd[1]. In this case, Court held whether employer has right to exercise control over employee is considered as important element as compared to actual control exercised by employer. This element is the strong evidence of employer and employee relationship. It must be noted that control test and integration test are not the strong evidence on which Court takes their decision. In other words they are not considered stand alone test by Courts. There is one more test that is multiple indicia test, and this test was established in Steven’s v Brodribb Sawmilling Co Pty Ltd[2]. In this case, the main issue is whether Gray and Steven’s are employees or independent contractors. Court applied multiple indicia test for determining the employment status of Gray and Steven’s and stated that Steven’s was an independent contractor. However, Court also stated further developments regarding this test are completely based on the interpretation of future judges[3]. Later this test is confirmed in case Hollis v Vabu Pty Limited[4]. In this case Court held that bicycle couriers are not working as independent contractor but they are considered as employee of Vabu Pty Ltd. Therefore, Vabu Pty Ltd is vicariously liable for the act of its employee who never identified on personal basis by individuals because he wears uniform of Vabu[5]. High Court of Australia stated that now a day control cannot be considered as only factor to determine the status of individual in the company. Multiple indicia test includes: Employee relationship is stated if worker integrated into the business of employer such as wearing uniforms, signage on vehicles, etc. Employee relationship is stated if worker is entitled to entitlement and allowances such as Leave, superannuation, workers compensation. A worker is considered as independent contractor if he arranges the taxation matter at his own. A worker is considered as independent contractor if that person is tradesperson or professionals and conducting their own business. A worker is considered as independent contractor if he was engaged to perform some particular task, and worker is considered as employee if he was employed for some definite period. If remuneration is provided in wages then person is considered as employee, and if remuneration is in the form of lump sum, price per volume or as per results then worker is considered as independent contractor. If worker sets his own place and hours of work then he is considered as independent contractor. If worker have ability to delegate his work then he is considered as independent contractor. If employer has control over the conduct of worker then he is considered as employee of the company, and if employer has control over the reporting then worker considered as independent contractor[6][7]. In the present case, Simone working in PR PRO, and she entered into an agreement with PR PRO at the end of 2012, to operate from 1 January 2013 until 31 December 2016. This agreement stated that Simone was not an employee of the company but she is abiding by all the rules of the company. Simone wears the shirt which had logo of PR PRO and she received agreed percentage of sales she made but she also receive small amount of base payment on a monthly basis. She paid income tax directly to the taxation department. Working hours of Simone are not set and she uses her own car for meeting the clients but she gets no allowance for that. She gets training from specialized agency and PR Pro pays for it. It is necessary for Simone to keep her phone all the time so she can answer her clients, and she receives extra payment where work took weekend and public holiday hours. Simone never gets any entitlement related to personal leave or holiday leave and company has never offered her any paid holidays. In this case all multiple indicia test is applied which discover following factors: After considering all the above factors it is clear that she work as an independent contractor in PR PRO. Annual leave is also known as holiday pay in Australia which means employee must be paid while having time off from work. Annual leaves entitlement introduced by National Employment Standards (NES). Any time of award or agreement cannot provide annual leaves less than those stated by NES but they have right to give more annual leaves. Annual leaves become part of NES standards 1 January 2010 and standards of NES apply to all employees covered by the national workplace relations system. All employees except casual employees have right to get paid annual leaves[8]. An English case law Morley v Heritage plc [1993] IRLR 400. In this case, there is general rule which stated that every employee was entitled to annual leave for the period of four months per year. Full time and part time employees of the company have right to get 4 weeks of annual leave, and these leaves are based on their ordinary hours of work. Employer cannot breach standard of NES and in case of breach of NES standards court imposed penalty of $10,800 for an individual and $54,000 for a company[9]. Annual leaves accumulate from the day of joining of employee, even though probation period of employee is not over. Accumulation of annual leave is done when employee is on: Accumulation of annual leave is not done when employee is on: In the present case, on 1/12/2016 Simone had a stroke because of which she lost her capability to work in the foreseeable future, and doctor stated that reason of stroke was high stress level, and her obesity. The reason behind this is that she had no holidays or weekends free from work for a long time. Simone has right to get 4 week annual leave as an employee of the company and company breach their duty under common law by not providing annual leave to Simone. Therefore, PR PRO breach their and court can impose penalty of $54,000 for breach of NES standards. In this case, PR PRO breaches their duty under common law by breaching the standards of NES for annual leave. Employee has right to receive notice from employer, and employer cannot terminate the employment unless he gives written notice to the employee. It is necessary that employer must issue notice to the employee personally, send the notice at last updated address, and sending notice to employee by pre paid post[11].   Minimum time period for serving notice to the employee: An employer’s cannot terminate their employees unless they give minimum period of notice or make complete payment of employees they have worked. Total employment period of employee Employment period of employee is not more than 1 year Employment period of employee is more than 1 year but less than 3 years Employment period of employee is more than 3 year but less than 5 years Employment period of employee is more than 5 year Every employee of the company is entitled to receive minimum period of notice or payment under FW act, and the period of notice is depend on the length of service of employee. It is the duty of employer to ensure that whether employee is entitled for higher period of notice[13]. This can be understand with the case law that is Lavarack v Woods of Colchester [1967] 1 QB 278 ('Lavarack'). In this case, Court sets out the general principle that in case of termination, employee has right to claim for what he is legally entitled. In the present case, PR PRO decided to replace Simone because of her disability to work in near future. In this case, Simone is working in the company from last 4 years and as per the requirement of FW Act PR PRO is under obligation to serve minimum notice period to Simone. As per the requirement to serve minimum notice period the length of service of employee is considered. Simone is working from last four years in the company and she is entitled to receive notice for the minimum period of three weeks. Hamilton Language is defined as the â€Å"Communication of thoughts and feelings through a system of arbitrary signals, such as voice sounds, gestures, or written symbols.† Yet this alone cannot sum up the importance and vastness of this magnificent gift human own. Language is one of the most amazing features of human culture and personality; its roots have remained unchanged since the start of civilization. It is the basis of all communication in the world and in it’s best is the most complex form of expression. Language has always been assumed to be blatantly cultural lying at the heart of human social evolution, but this could not be farther from the truth. Language owes as much to instinct and innateness as it does to culture. Darwin once described language as an â€Å"instinctive tendency to acquire an art†; this view of language was re-revealed to the world through Noam Chomsky, in his book, Syntactic Structures. Chomsky argued that language is shaped through culture, but the underlying ability to learn and understand it, is innately built into the human psyche. Chomsky concluded that there were obvious underlying similarities in all languages, bearing witness to a â€Å"Universal Human Grammar†. We always use this ability to learn and use language, but we are not consciously aware of it. Vocabulary cannot be innate, because if it were were, we would all speak one, unvarying language. But lets take for example, a child; as it learns vocabulary, innate mental rules tell that child how to properly use that vocabulary. Lets take, for instance the sentence, â€Å"Sa mmy will buy groceries from the store†. You can turn that sentence into a question by moving the ‘will† to the front, making the sentence, â€Å"Will Sammy buy groceries from the store.† Young children can comfortably use this rule, even though never having been taught about the grammar involved in making a sentence like that, they just seem to know the rule. As psycholinguist Steven Pinker put it, â€Å"to learn a human language, requires a human language instinct. Language is not learned through imitation; if it were then why would children who have been using the word â€Å"went† for a year or so, start saying â€Å"goed†. The truth is that children start learning to speak themselves, at a much younger age regardless of our help. Children are a large part of developing a language; this was shown in a famous experiment conducted by Derek Bickerton.
